PULSE MMS — TERMS & CONDITIONS
Agreement Overview
These Terms and Conditions (“Agreement”) govern your use of Pulse MMS (“Company,” “we,” “our,” “us”) services, website, and dashboard. By accessing or using our services, you (“Client,” “you,” “your”) agree to be bound by this Agreement and any applicable written contract executed between you and Pulse MMS. If you do not agree with these terms, you must not access or use our services.
Services Provided
Pulse MMS provides business-to-business MMS and SMS marketing services, including message creation, audience list management, campaign scheduling, analytics, and account support. All campaigns are subject to compliance verification and carrier review.
Account Registration & Contracts
To use Pulse MMS, each client must complete onboarding, sign a service agreement or contract, and maintain accurate business information. Pulse MMS may suspend or terminate accounts that violate these conditions or applicable laws.
Payment & Billing
All services are prepaid or billed per usage agreement. Payments must be completed before campaign activation. No refunds are issued after purchase or campaign submission, regardless of message delivery results, account cancellation, or non-use. All payments are final and non-reversible.
Compliance & Client Responsibilities
Clients must fully comply with the TCPA, CAN-SPAM Act, 10DLC carrier rules, and state/federal marketing laws. Messages may only be sent to recipients who have explicitly consented. Pulse MMS is not liable for penalties resulting from client misuse or illegal messaging activity.
Message Content Restrictions
Clients are responsible for all content sent through their accounts. Messages may not include illegal, misleading, or infringing material. Pulse MMS reserves the right to review or reject campaigns violating these standards.
Cannabis & Restricted Industries
Pulse MMS allows legal businesses in restricted industries, including cannabis and supplements, within applicable state and federal laws. Clients must ensure content compliance and may be asked for proof of licensing or legal documentation.
No Refunds Policy
All payments are non-refundable. Once campaigns or credits are activated, no refunds or partial credits will be issued, including cases of account termination or delivery variance.
Data & Privacy
Client data and contact lists are stored securely using encrypted environments. We do not sell or share client data except as required by law or with trusted vendors for service delivery. Data is deleted upon termination or per legal requirements.
Limitation of Liability
Pulse MMS shall not be held liable for delivery delays, data loss, or indirect damages. The maximum liability shall not exceed the total amount paid by the client in the preceding 30 days.
Termination
Accounts may be terminated for breach of terms, abuse, or non-payment. Outstanding balances are due immediately upon termination.
Governing Law
This Agreement is governed by Michigan state law, with exclusive jurisdiction in Wayne County courts.
Updates to Terms
Pulse MMS reserves the right to update these terms at any time. Continued service use implies acceptance of updated terms.

How We Use Information
Data is used to operate and enhance our platform, manage billing, provide support, and ensure compliance. We never sell or rent client data.

All information is stored in encrypted systems with restricted access. Authorized personnel operate under strict confidentiality policies.
Data Retention
Data is retained only as long as necessary for service delivery or compliance. Upon account closure, data may be deleted within 90 days unless otherwise required by law.

Cookies & Tracking
Our website may use cookies for analytics and functionality. Users can disable cookies via browser settings.
Third-Party Services
